Rules and Regulations

Please read these rules and regulations and share them with your household members, visitors and friends.

The Community of Beltzville Lake Estates Inc. was formed to maintain and advance the social and civic interests of the property owners at Beltzville Lake Estates. In this connection, we ask your cooperation in understanding and complying with the following rules and regulations.

The Board of Directors has the power to enforce the by-laws and the rules and regulations, and protective covenants. Until such time that the need for formal enforcement, by issuing violation papers of some sort becomes necessary, we ask that you cooperate with personal understanding with one another. Adults or children, who do not comply with our rules and become defiant or repeated offenders, will be disciplined by the Board, at last resort in the interest of the majority of law abiding owners and guests. Any major problem should be directed to one of the board members, or if unable, to the Pennsylvania State Police immediately.

Any property owner confronting a trespasser or violator, on his own or taking the law upon himself as a self appointed vigilante, acts on his/her own behalf and the Community of Beltzville Lake Estates Inc. will assume NO responsibility whatsoever for any resulting actions.

 


Section I – Road Regulations       Back to the Top

1. The speed limit within the boundaries of Beltzville Lake Estates, Inc. is 15 MPH.
2. No vehicle of any kind is permitted on the beach, or any surrounding area of the lake, except the designated parking areas by the beach and the picnic area. No parking is permitted on the shoulders of the roads. All vehicles must be parked in private driveways or designated parking area.
3. No vehicle of any kind shall trespass on another person’s private lot.
4. All powered road vehicles including automobiles, trucks, motor homes, ATVs, snowmobiles and motorcycles and motorbikes must be registered with the Community of Beltzville Lake Estates, Inc. and an ID sticker affixed as follows:
1. Automobiles, trucks, motorcycles, motorbikes and motor homes; anywhere visible from the rear.
b. Snowmobiles -place on the left side next to the state of Pennsylvania Registration sticker.
c. ATVs -place on the left rear fender next to the state of Pennsylvania Registration sticker.

The purpose of the vehicle identification sticker is to more readily spot intruders in our community, and to identify persons who disobey our rules and regulations. Every person operating a recreational vehicle within the boundaries of Beltzville Lake Estates, Inc. shall be liable and responsible for death and injury, or damage to property, resulting from the use or operation of such vehicle.

Note: Additional identification stickers are available from the Secretary at a cost of $1.00 each. ID stickers need not be renewed on a yearly or regular basis; only when worn that they are illegible.

5. Pennsylvania laws and restriction governing the use and operation of motor vehicles on the roads under the jurisdiction of the Pennsylvania Department of Transportation shall apply to all the roads at Beltzville Lake Estates, Inc.
6. Regulation helmets must be worn by anyone riding motorcycles, motorbikes, ATVs, and snowmobiles.
7. On all motorcycles, motorbikes, ATVs and snowmobiles, headlights and taillights must be turned on when operating, and vehicles must be in good operating condition, including proper muffler baffles.
a. Hours of operation will be 10:00 a.m. to 7 p.m. daylight savings time and 10:00 a.m. to 5:00 p.m. standard time.

THE USE OF THE LAKE AT ALL TIMES IS AT YOUR OWN RISK!

A. Swimming
1. Specific rules and regulations are posted at the beach and/or in the Hospitality House.
2. An adult should accompany small children.
3. No single person shall ever be in the lake, unless there is at least one or more swimmers on the beach.
B. Lake
1. No boats powered by liquid fuel or electricity are permitted in the lake.
2. Canoes, row boats, plastic/rubber rafts are permitted, but shall maintain a safe distance. Pennsylvania boating laws are to be observed.
3. Fishing is permitted at any time. A Pennsylvania license is required. The Rules and Regulations of the Pennsylvania Fish and Game Commission are to be observed. Clean up your fishing area of bait cups and other debris.
4. A modest amount of game fish will be stocked yearly.
5. Ice fishing, skating and snowmobiling on the lake should be attempted only when the ice is of sufficient thickness. Safety ropes and life rings should be on site in the case of an emergency. Use of the lake in the winter should be done with two or more in a group.
6. The primary use for the Hospitality House is intended to be a pavilion in inclement weather. Kindly clean up after use. There are trashcans provided outside the pavilion.
7. If you use the outside cooking pits in the picnic area, make sure the fire is out before you leave.
1. The use of GLASS in any manner is prohibited in the beach area.
2. Hospitality House curfew : closed 11:00 p.m. – 7:00 a.m.

1. All lot owners in the community who produce garbage/trash shall have such garbage/trash collected by the contractor designated or employed by the Association/Inc.
2. Littering is prohibited. This includes, but is not limited to: leaves, grass cuttings, brush trimmings, personal unwanted items or animal waste placed on private or community property.

Section V—Firearms & Explosives Regulations       Back to the Top

1. No one shall discharge a firearm including BB guns, air rifles or air pistols, anywhere on common areas or Greenbelt within the boundaries of Beltzville Lake Estates.
2. No one shall detonate or set-off fireworks or explosives unless done so in and upon the owner’s property, or in connection with an approved community event. State laws of Pennsylvania must be observed.
3. There shall be no hunting conducted on owner’s lots or on any property in the Community of Beltzville Lake Estates, Inc. The laws of the State of Pennsylvania must be observed.
4. Firearm discharge must be in compliance with Pennsylvania State laws.


Section VI—Building Regulations       Back to the Top

1. All deed restrictions and protective covenants applicable to lots shall remain in effect and are incorporated herein as though specifically set forth in these Rules and Regulations.
2. The Penn Forest or Towamensing Building Ordinances must be complied with and a building permit from the appropriate township received prior to construction.
3. Owners are expected to maintain property and/or structures within acceptable standards. If health or safety hazards are apparent or the property is considered to be an unattractive nuisance, the owner will be notified and given thirty (30) days to correct the problem.
4. It is the responsibility of the homeowner/lot owner to repair or pay for repairs; if a worker or contractor they hire does any damage to community roadways or other community property.
5. There shall be no construction prior to 7:00 a.m. or after 8:00 p.m. Monday through Friday, and prior to 8:00 a.m. or after
8:00 p.m. on Saturday and Sunday.


Section VII—Animal Regulations       Back to the Top

1. All animals must be confined to the property of the owner or be on a leash if being walked.
2. Animals are not permitted on the BEACH.
3. Animals must be kept under control of their owners at all times.


Section VIII—Enforcement       Back to the Top

1. Whenever it is determined that a member of the Association/Inc. violates any of the restrictive or protective covenants of the Association/Inc., a cease and desist order shall be issued by the President of the Association/Inc. If, after written notice of the cease and desist order, the member fails to correct the condition resulting in this order within thirty (30) days, this shall constitute a punishable offense and the member shall incur a fine of $200.00 per day until the condition iscorrected. The member may appeal the issuance of a cease and desist order to the Board of Directors within ten (10) days of the receipt of the order.
Each member of the Board of Directors shall have one (1) vote and all Decisions shall be made by a majority vote of a quorum of the Board. A Quorum shall exist when two-thirds (2/3) of the Board of Directors are Present at the appeal. The appeal shall be made by the member by submitting a written request to the Board. The written request shall state the reasons why the member disagrees with the decision of the President and any other information the member deems pertinent to the appeal.

The Board of Directors will consider the appeal at its next regularly scheduled meeting. The member making the appeal shall be permitted to attend the meeting and be permitted to make a statement as to the reasons for his appeal. The Board of Directors shall make its decision at an executive session provided a quorum of the Board of Directors are present. If a quorum is not present, the appeal shall be adjourned and considered at the first available meeting of the Board of Directors at which a quorum of the Board is present. The Board of Directors shall notify the member in writing thereafter. All decisions of
the Board is final.

2. Whenever it is determined that a member of the Association/Inc. violated any of the rules and regulations of the Association/Inc. or the Bylaws of The Association/Inc., a warning shall be issued by the President of the Association/Inc. Whenever it is determined that a member violates any of the rules or regulations of the Association/Inc. or the Bylaws of the Association/Inc. within 365 days of the first warning, this shall constitute a punishable offense and the member shall incur a fine of $100.00. The member may appeal the issuance of a warning or fine to The Board of Directors within ten (10) days of the receipt of the warning or fine.

Each member of the Board of Directors shall have one (1) vote and a decision shall be made by a majority vote of a quorum of the Board. A Quorum shall exist when two-thirds (2/3) of the Board of Directors are present at the appeal. The appeal shall be made by the member by submitting a written request to the Board. The written request shall state the reasons why the member disagrees with the decision of the President and any other information the member deems pertinent to the appeal.

3. Any unpaid fine or assessment shall be a lien on the member’s property and shall be collected by the Association/Inc. in the same manner as a past due assessment.


Section IX –Membership       Back to the Top

1. All lot owners are obligated to pay annual fees to the Association/Inc. pursuant to the protective covenants.

2. Membership rights and privileges shall be suspended for non-payment of the annual fee.

3. Delinquent/non-paying members and members of the same household shall not be permitted the use of community property as a guest of a paying member.


Section X       Back to the Top

1. No camping or sleeping in vehicles at parking lot, or camping on beach and picnic areas.

2. Camping is allowed in the old ball field area with the approval of a Board Member. No fires will be allowed in the camping area at any time.
